Background information

As part of its continuing statutory revision program, the council has engaged in a nonsubstantive revision of the Texas Probate Code, enacted as a new Estates Code. The council revised the Texas Probate Code as the Estates Code in two installments. Prior to the regular session of 81st Legislature, the council staff revised the decedents' estates portion of the code, with a few exceptions. Last interim, the council staff completed the revision of the code, including the guardianship portion. Several meetings were held with probate law experts to discuss and develop the plan for this project. The entire Estates Code will become effective January 1, 2014.

The first installment, as enacted by the 81st Legislature, is under the direction of Maria Breitschopf of the legal staff.
